Hey there! Welcome to THE COMPANY. We're a small development studio doing custom software work, freelance projects, and building our own cool stuff (our "Services"). These Terms of Service ("Terms") explain how you can use our website (the "Site") and work with us.

By using our Site or Services, you're agreeing to these Terms. If anything here doesn't sit right with you, then our Site and Services might not be the best fit.

1. What We Do

THE COMPANY offers custom software development, freelance help, and our own software products. When we do custom or freelance work for you, we'll have a separate, clear agreement that details everything for that specific project (the "Client Agreement").

2. Using Our Site & Services

Please use our Site and Services responsibly and legally. Don't do anything that could mess things up for us or other users.

3. Our Stuff (Intellectual Property)

Everything on this Site (like our name, logo, text, and any software we own) belongs to us or our partners and is protected by copyright and other intellectual property laws. For custom projects, our Client Agreement will spell out who owns what. Any products we build ourselves are ours.

4. Your Part (For Custom/Freelance Work)

If we're building something for you:

  • Give us clear info and feedback when we need it.
  • Make sure anything you give us (like content or designs) is yours to use.
  • Stick to the payment plan we agree on in the Client Agreement.

5. Cancelling Services

  • Custom/Freelance Projects: Our Client Agreement will explain how cancellations work, including any non-refundable deposits or payments for work already done.
  • Our Products (If any): If we sell our own products (like a subscription), the cancellation details will be clear when you sign up.

6. Payments, Refunds, and Disputes

At THE COMPANY, we're all about delivering quality work. This section explains how we handle payments, refunds, and disagreements, which are mostly guided by our specific Client Agreements.

Client Agreements are Key:

Every custom project has a Client Agreement. This document clearly lays out the work, payments, and how we handle things like cancellations or issues.

Our Refund Stance (Non-Refundable):

  • Work Done is Paid For: Once we've done the work (hours spent, milestones hit) as agreed in your Client Agreement, those payments are non-refundable.
  • Deposits: Any upfront deposits to start a project are also non-refundable. These cover our initial time and commitment to get your project rolling, as outlined in the Client Agreement.

We believe good communication throughout a project is the best way to make sure everyone's happy.

Our Own Products (If We Have Them): If we sell our own software products, the refund details for those will be clear when you buy or subscribe.

Handling Disagreements:

  • Check Your Client Agreement: If there's any disagreement about our services, the first place to look is the Client Agreement you signed with us. That's our main guide for sorting things out.
  • Talk to Us First: If you have any concerns, please tell us as soon as possible. We're committed to being professional and working things out based on our agreement.
  • Formal Issues: If talking doesn't solve it, the Client Agreement will explain the next steps, including which laws apply.

7. How Far Our Responsibility Goes (Limitation of Liability)

We always aim to do great work, but we provide our Site and Services "as is." This means we can't promise everything will be perfect or always available. To the extent the law allows, THE COMPANY won't be responsible for any indirect damages or losses (like lost profits, data, or business opportunities) that might happen from using our Services, things beyond our control, or unauthorized access to your information. If something does go wrong because of us, our total responsibility is limited to the amount you've paid us for the specific Service involved.

8. Covering Us (Indemnification)

If your actions while using our Site or Services (or if you break these Terms) cause legal issues or costs for us, you agree to cover those costs for THE COMPANY.

9. Changes to These Terms

We might update these Terms sometimes. If we do, we'll change the "Effective Date" at the top. If you keep using our Site or Services after that, it means you're okay with the new Terms. It's a good idea to check back here occasionally. For active projects, the terms of your specific Client Agreement will prevail for its duration.

10. The Law We Follow

These Terms are based on the laws of the main place where THE COMPANY operates.
